II.1) DESCRIPTION

II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): Background:
Leicestershire County Council's ICT Function provides services to the
Council and its Departments via a combination of its in house team and
numerous ICT managed service contracts, many of which are due to expire in
2009. Whilst the Council maintains a reasonably sized in house team it has
bought in new skills to support the provision of a responsive service.
Re-procurement of such services provides potential for realisation of key
strategic benefits for the ICT Function such as operational efficiency,
solution flexibility and cost reduction.
Scope of the proposed contract: In seeking a technology partner,
Leicestershire County Council has identified the following services for
initial inclusion in the proposed new contract: Wide Area Network; Local
Area Network (fixed and wireless); Fixed telephony (internet protocol and
carrier services); Mobility Services (voice and data); External
connectivity solutions (e.g. internet).
This scope has been influenced by several factors which include: the
ability of suppliers to deliver all required services; the ability to
define service boundaries clearly; and the organisational and cultural
impact and level of risk associated with the scale of change. Applicants
should also note the following:
1 Because of the termination dates of existing contracts, there is likely
to be a phased implementation of the new contract, spread over
approximately 12 months.
2 The contract will be awarded for a nominal three- or five-year period,
with initial service provision (for those elements where existing
contracts are due to expire) commencing Summer 2009. (Tenders are likely
to be invited on the basis of both three- and five-year options, in order
that the costs and benefits of both can be weighed against the Council's
future ICT strategies and the desire to retain flexibility.
3 A number of options will be incorporated into the contract. These will
include: Extension of the contract beyond its initial three- or five-year
term for up to five further years (on an incremental basis); Flexibility
for the contract scope to evolve over time, in order that (subject to
reaching satisfactory agreement with the service provider) additional
services may be included where these are reasonably within the broad remit
of the initial specification, and are complementary to delivering the
objectives and the service and value for money improvements sought by the
Council; The right for the Council's operational partner organisations to
participate in all or some elements of the contract (these partners may be
any public bodies, regionally or nationally, with whom the Council works).
The options outlined here do not, however, preclude Leicestershire County
Council from undertaking future procurement exercises in order to address
its future requirements in the longer term.

approximately GBP 1 900 000 per year, but the overall contract value, if
all options are exercised, could be in excess of GBP 40 000 000.

(f) has not fulfilled obligations relating to the payment of taxes in
accordance with the legal provisions of the country in which he is
established or with those of the country of the contracting authority;
(g) is guilty of serious misrepresentation in supplying the information
required under this Section or has not supplied such information;
(h) has been the subject of a conviction for participation in a criminal
organisation, as defined in Article 2(1) of Council Joint Action
98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in
Article 3 of the Council Act of 26.5.1972 and Article 3(1) of Council
Joint Action 98/742/JHA3 respectively;
(j) has been the subject of a conviction for fraud within the meaning of
Article 1 of the Convention relating to the protection of the financial
interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined
in Article 1 of Council Directive 91/308/EEC of 10.6.1991 on prevention of
the use of the financial system for the purpose of money laundering.
