II.1) DESCRIPTION

II.1.5) Short description of the contract or purchase(s): Health and
Social Care in Northern Ireland has a requirement to award a framework
agreement with a technology partner to replace existing arrangements. The
purpose of the framework agreement is the delivery and/or support of
regional ICT projects, and it will be available for use by HSC Trusts,
Boards and other HSC bodies, as well as the Authority, and any successor
bodies of any of these organisations. The technology partnership
arrangement will cover a comprehensive and broad range of ICT and related
supplies and services, including, without limitation to the generality of
this: Supply and support of Hardware used to deliver ICT services and/or
interface with network attached medical devices; Supply and support of
Software, including a range of off the shelf products; Supply of Original
Equipment Manufacturer (OEM) hardware, software and services; Supply of
services such as technical and advisory services (typically non complex
services, typically one-off and of defined duration), both directly and
using third party staff; The design and/or build and/or operation of
systems / services that integrate as appropriate with the Departmental /
HSC infrastructure and applications. These could involve OEM supply and
third party staff; Delivery of the high levels of availability required by
clinically critical and business critical services within HSC; Bespoke
Application Development and Support; • Best practice service management;
Managing multiple organisations (including potential competitors) to
deliver products and services; New OEM requirements; Facilitation of
Authority access to sub contractors and/or consortium member
organisations. Further information concerning the proposed agreement and
the Authority's requirements is contained in a Memorandum of Information
which is available at www.techpart.hscni.net or on request from the
Authority at I.1.

Regulations 2006 (implementing title II, Chapter vii, section 2 of

www.techpart.hscni.net or on request from the Authority at I.1. Completed
PQQs must be returned to the Authority at the address in section I.1
before the deadline specified in section IV.3.4.

Authority intends to invite operators to participate in the dialogue on
the basis of the order of ranking of candidates at the PQQ stage at which
the criteria referred to in Part 4 of The Public Contracts Regulations

be assessed and marked.

: (i) not to award any contract as a result of the procurement process

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: The Authority will incorporate a minimum 10 calendar day
standstill period at the point information on the award of the contract
framework agreement is communicated to tenderers. This period allows
unsuccessful tenderers to seek further debriefing from the contracting
authority before the framework agreement contract is entered into.
Applicants have 2 working days from the notification of the award decision
to request additional debriefing and that information has to be provided a
minimum of 3 working days before the expiry of the standstill period. Such
additional information should be required from the addressee in section
I.1. If an appeal regarding the award of the contract has not been
successfully resolved. The Public Contracts Regulations 2006 (SI 2006 No.
5) provide for aggrieved parties who have been harmed or are at risk of
harm by a breach of the rules to take action in the High Court (England,
Wales and Northern Ireland). Any such action must be brought promptly
(generally within 3 months). Where a contract has not been entered into,
the Court may order the setting aside of the award decision or order the
authority to amend any document and may award damages. If the contract has
been entered into the Court may only award damages. The purpose of the
standstill period referred to above is to allow parties to apply to the
Courts to set aside the award decision before the contract is entered
into.
